This discussion is something we can't logically conclude.

Do you think it might be a good idea to ask people to pledge amount that they don't know how much is going to be ?
I think instead we need to do the following.
1. Clearly state in the very first message the need for creating this thread (pls include the business week article, Pappu's comments, comment from Aman's co worker - If you need help finding it, i can do it for you).
2. Also add to it that this is for the reimbursement of the expenses of the past. We don't really want to concentrate on how this is going to be handled in the future , may be someone can come up with suggestions on what should be set aside as administrative funds and things related to that. This is only for settling the amount already spent.
3. Only pledge is required stating the amount clearly and no funding is required at this time. We will instruct all the members who pledged once we get an expert advice on how to channel these funds.
If you can make these corrections it will be great.

desi companies r indian companies and they sell LC openly , Eb2 pre approved labor has a rate approx 20k USD .
desi companies sell H1b also , u pay money and they will get it for u , see sulekha.com for example .
I am not in the IT industry so I have no idea about these Desi companies till today. If they sell EB2 LC for 20k USD, how come there are still so many people waiting instead of buying a GC?

IMO standalone bills like these have little chance of passing. This is just a placeholder so that its text can be used in the CIR. Such bills are used to gauge the public reaction and the senates direction on the issue. The bill needs a companion bill from the house which will be difficult considering the composition of the house. In the coming months you will see many immigration related bills being introduced. We can always hope and write a letter to the senators about this bill, it has a better chance if there are more co sponsors.

Dont lose hope and dont lose sleep over it. I know it's easy to say...but just hang in there. Everything will be ok. As someone suggested, all you will be losing is at most 10K. Even that, you can transfer to some where else and should not be paying a cent. Why go now itself? Let's suppose that the judgement is not in your favour, may be , after a couple of years. Then you can quit your job and say you are leaving. I dont think they can stop you at that time. And I dont think they can make you work either, if you decided not to take up a job. Then file banktrupcy and go back to your country. Relax for a couple of years and then come back.
So, all i would suggest is stay calm and let the trial take it's course.
If you do not want to go through all this stress then as someone suggested , try for an out of court settlement. Tell them all you have is about 2K( take off all the money before that). Then they will know what your position is and might settle for that. Better take an attorney so that this is settled for once and all.
It's possible that the target might not even be you. There might be some millionaire in one of the other cars.
That's my 2 cents.

My I-140 got approved even though my company also did not file 2006 Tax return. My company is a small(less than 30 employee) loss making company. About 3 weeks back I had transfered money to my parents account in a Nationalised bank. I have been sending money to that account since a while. For the last transaction I did, I never got an email from SBI saying that the credit has been posted, but 6 days after the transaction the online status was showing that the beneficiary account has been credited. My parents enquired at their bank 3/4 times and everytime they were told that the money has not arrived from SBI. When I posted a customer care ticket, after I got reply after 2 days that the account number I had provided is incorrect. I replied them what the hell, you have transfered the money to same account earlier and how will the number change all of sudden. Then no reply for next 2 days. After asking them again about the status I was told that the beneficiary bank has moved to CORE banking so the account numbers are different now. When my parents asked about it, the bank told them that the CORE banking was completed 2 years ago and the current account number is the right number. I asked my parents to call SBI GLS customer care number in Mumbai and complain about this. The buggers from SBI called me in the middle of night (1.30 AM) and told me the same thing that the numbers are incorrect. After arguing with them for one hour in midnight, finally they agreed to their mistake. So the whole transaction took about 15 days to get the money transferred. Stupid people have given a 877 customer service number for US, but they work according to IST so the number works only till 9:00 AM EST later it just keeps ringing. SBI online service is sure working like any other Indian Govt office...

I think the idea is that we need to sell ourselves. I was the other day debating on www.cio.com and believe me, that was a tough exchange. Several US IT pros (mid management, engineering, etc) arguing that they are highly qualified and got laid off and cannot find a high paying job anymore. I had to sell myself and argue that our skills are needed, etc. I believe that we are still needed in this country and it is not all that easy to find "good" IT professionals. That's why we are here. However, I am very concious about the number of folks who Americans are willing to let in without hurting them.
"Demand" and "right" will work up to the point in which we don't irate Americans. America has been sympathetic to immigrants in good part thanks to the capacity that America has to accomodate us here. If an excessive number of immigrants get in and that alarm citizens, I can tell you this country will become as unsympathetic to immigrants as many European countries are.
LogicLife is doing a good thing by being so positive. Let's continue to sell our skills in a professional manner. Just be careful with the idea of "demanding" and "rights" though :)

I have seen hard workers laid off left and right, be it US citizens, green card holders or H1Bs. In fact one of my GC friends said that it is a constant fear for him to be employed at all times, he was unemployed for 10 months after the dot com bust. That changed him completely, he said what will I do with my GC, can I feed my kids with a GC? I need a job. So it is everyone's perspective. I look at him and say at least you have a GC, he says at least you have a job. :)
I still think that GC is not a right. It is a privilege, as is a driving license. You have to pass the drivers test to get a license. Logiclife's message from centuries back about anyone being able to move to another country does not work in today's world. There were no visit visas needed to get to India or China for example in those years, but why is it a requirement to have a visa to visit India now? Things have changed.
BTW, I do think we should do what we can to improve the immigration process, but if nothing gets done its not the end of the world. We can "ask", "request" Congress to change laws. But surely you are not saying we "demand" for our rights to have a GC?
