    This is becoming a messy going forward ...we are keeping hopes that it will be better next month.....so far our hopes are left over as hopes only...

    Yes, due to CIS lack of capability they have wasted thousands of visas, that is not our fault then why we are suffering......we have been working hard and contributing this economy in all the ways......then why can't we treated to get our legitimate benefits??????

    We have wasted/spent years and year here by treating US as our home country....hopeing one day we will get our GC.....but now the way things are moving ..totally we lost our destiny.....and for me (I am sure quite a few out there too) it is not that easy to go out and start the life from scratch again...

    IV should stand up and do something...we are with you.

    Dear IV Members,

    If you believe that your success depends on your immigration process - whether it's the ability to file I-485 earlier or to get green-card and citizenship sooner or whether it's the ability of your spouse to work - then you have to believe that your success somehow depends on the success of Immigration voice and these 170 volunteers in DC next week.
    As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
    If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

    one of the leading lawyer's client reported that he got his H1B approved for a multi-layered consulting situation without even a client letter. So it depends on the lawyer who is presenting the case.

    Anyways let us wait and see.

    I didn't know this...

    This is applicable when 140 has been approved. If 485 is retrogressed then you will get 3 year extension. If it's current you will get 1 year extension. Guess depends on luck. For e.g if some one has applied for extension in July he/she will now get only 1 year. I found this in a lawyer's chat transcripts.

    Well said, Logiclife. Life is a movement, fight. You won't get much (if anything at all) if you just wait for someone to give it to you. You have to get it.

    Except the native Indians, everybody in this country is an immigrant or a discendent of immigrants (and many of them illegal, btw, but they quickly forgot that...). But once they settle, the ex-immigrants immediately start putting hurdles before the new immigrants - laws of nature! Now we have: "Immigration is a privilege, not a right" :-) Come on!

    Our case is a tricky one because we do not have enough leverage to push the government to resolve quickly the mess it created with the backlog and the retrogression.

    The only way to fight it is to expose our case broadly via the US media. I was promoting this idea since I joined IV. In the beginning I was critisized for that since the core group thought that lobbying was an universal tool but later they changed their mind. So, I deeply believe that broad media coverage can only help solving the legal immigration mess.

    You didn't answer my question. Can you work for two companies processing your green card at the same time. I am working for employer A for 13 years and EB3 green card process pending for 8 years. Now while working for Company A, Can I start green card process through Company B(for part time work) and do porting to EB2? Please clarify. I am not intending to quit immediately after getting Green Card, I will work for 6 months after Green card for Company B(for part time)?

    Is this legal to work full time for one company and part time for another company(I have EAD), both of them are processing green card at the same time? Is there a chance of getting RFE's OR Is there a chance of getting your original application getting rejected because of multiple employments and two green card process's at the same time.

    How did you send an email to TSC streamline? My case is at TSC and we are half done...primary approved and dependent pending...told biometrics issue by lawyer thru AILA but as far as these forums go biometrics don't hold an approval otherwise I won't have been approved. i guess we carry the curse of transfered cases...mine was TSC-CSC-TSC

    I understand your frustration. Believe me I have gone thru the same.

    When I filed for my I-485 in 2000, the PD was current for me for 23 months in row when it got approved. Can you believe this? PD was current for whole 23 months while I-485 was pending.

    One of my goals is to help my future legal immigrants. Being a US citizen gives me vote voice and power. I am open to suggestions. I would like to help my fellow legal immigrants.

    I know, the wait time is long, but it is worth it every bit.

    Hmmm so you have been a victim of random processing too? The situation is a mess no doubt. But this random processing really hits where it hurts the most...

    IF ONLY everyone who gets a GC approval or citizenship could work at the CIS for a year... a sort of community service.... All of the problems wrt the random processing will go away...

    I am sure most people on this board can hit the ground running and don't require extensive training... unlike the present day IOs.

    could it be that ppl will not be able to sneak in with pre-approved labor now? if there is a significant number doing that, the PDs will move faster. Congrats IV on this achievement!

    Isme IV ka kya haath hai. USCIS wanted to do it so they did it. IV or me I should say is just going to push when time comes to remove retrogression,
    that is what we can do now. Our reforms are linked to CIR so pray.

    I totally agree. They want to issue visas to all of them in a year... They will have more RFEs for legals than illgeal so people should work towards their temporary permnanent residency that is Z


    You can call Jose in Mexico and they ll deliver a passport in less than a week. ALL WE NEED IS TO REGISTER A LAWN MOWING FIRM and then BILL THE CLIENT at 100$/Hr for first designing the plan for the mowing on a computer and then getting a MEXICAN to do it for us. ...;-)

    Many folks suggest that this BIll (when turns into a law) would promote outsourcing..but how does these set of changes being proposed by Odama's admin. would affect outsourcing??

    I know it wont "stop" outsourcing in any way but seems like they claim that they are " taking away the tax advantages of companies shipping jobs overseas"...Iam sure its more complicated than that..

    However the kind of tone being set by the incumbent these days, I believe reflects the current administrations policies that might trickle to us(documented workers) as well.. not sure..

    However this can be also looked at, the adminstartion si trying to "show" that they are doing whatever they can disccourage companies from sending jobs overseas..and then eventually take a stab at CIR..wishful thinking..:D

    Nice post, containing real facts.

    You are purely thinking about your perspective and neglecting the purpose of GC for the country.
    To qualify in EB1/Eb2/EB3 depends on some factors:

    EB1: Extra ordinary candidate, may or may not be represented by employer
    EB2: Senior Level: Job duties have to justify need for advance degree candidate (or BS + 5yrs exp) and then candidate must qualify too
    EB3: 16 years of education (ideally) with degree in related field (lets talk IT for now)

    Now current status and its cause:

    EB1: - No jumping, no gaming system : Hence NO DELAYS

    EB2: - Good chunk with genuine apps, some gaming system where applicant qualify but not the job, some gaming system and taking very high risk by showing BS +5 yrs (they actually don't have +5 factor), other jumping the category (legally :D) but taking very high risk for RFE

    Result: Got retrogressed

    EB3: Good chunk with genuine apps, some unfortunate ppl who do qualify but job doesn't support experience or higher pay, lot of gaming system with BS (3yr) in non Computer/IT and showing 1yr certifications etc, and everybody who does not qualify for EB1/EB2, lot of nurses (I heard someone said nurses in back)
    Result: Severely retrogressed with no hopes in horizon

    Now lets look at market demand ( we know supply of apps is pretty darn good)
    EB 1: Very very high : general pay range starts from $250k+ and goes up to $400k for fresher (PHDs) and in upper $150k for Int'l Managers

    EB 2:: High, general pay starts high $80k and goes somewhere $140k+,

    EB 3:: good, starts from upper $40k and goes somewhere $65-70k, (lots of job and lots of applicant)

    Now lets take a look at Supply of Apps (Assumption 1M apps already in system):
    EB1: say 50K (5%) - (fast processing - Express lane)
    EB2: may be 200K (20%) - (sounds good on paper but in realty slow but moving)
    EB3: everything else (75%) (OMG :eek: stampede : frustration with no visible progress)

    Now lets checkout preference:
    Preference from perspective of country, what benefits country the most:

    EB1: ohh : lets get them in ASAP
    EB2: yes yes we welcome you please come in (after some long wait)
    EB3: OMG its flood of ppl, use extra strong flood gate and keep them out as long as possible, and let them in with very low rate


    Now This:
    Like everything in the world, the fewer the qty the hotter the product,
    the abundance kills the market, applies perfectly with EB2, in 2000-2001 it used to take 12-24 months and you have GC in hand, and now .. may be by my kids turns 16yrs, and EB3: 2000-2001 use to take about 3 yrs and but right then we started getting flood, and thanks to 200K H1bs in 2001-2.

    End of the day EB1/EB2/EB3 all are immigrant and are victim of broken system (I�m sure EB1 disagree here with me because they enjoy express lanes), it need fix but is it high priority for law makers or we just think it is?
    how desperate we are to provide help? or we are just good at reading/writing here and using IV and other forums for venting out? ask yourself

    The list goes on and my analysis goes on, but these are just my thoughts thinking out loud,
    and trying to think for a solution.... Next thought -> Solution, I will post in coming days

    Senator Frist listens as Dr. James Wingate, President of LeMoyne-Owen College in Tennessee, expresses support for the inclusion of the SMART Grant program in this week's Senate budget reconciliation bill, 11/2/05
    February 2006 - Every time I visit Silicon Valley I'm reminded of a simple fact: American businesses lead the world because they employ talented people. From the top executives at companies like Apple and Cisco to the science and engineering students I'll speak with Monday at San Jose State University, Americans sit on the cutting edge of technology.

    We have less than 5 percent of the world's population but produce almost a quarter of its wealth and enjoy the highest per capita income of any large industrial economy. Americans receive more patents than the citizens of any other country, have the world's best university system, do most of the world's basic research, and take home the lion's share of Nobel Prizes in the sciences.

    As many people working in Northern California's technology sector have realized, however, we can't afford complacence. China and India together now produce at least twice as many engineers as the United States. Both have fast growing populations and high-quality universities. In search of profits, companies have begun to outsource more low- and medium-skilled jobs to these nations.

    No amount of funding, furthermore, would allow the United States to catch -- much less exceed -- China and India's combined production of scientific personnel. We just don't have enough people. Even at our own universities, foreigners earn an ever-increasing percentage of degrees in the hard sciences. Some remain, but many end up taking their valuable skills back home. American companies, meanwhile, have thousands of scientific and engineering openings that they can't fill.

    If we hope to remain the world's pre-eminent economic power,/ we need to produce more scientists and engineers and train them better. One recent study, indeed, found that 85 percent of income growth stems from technological change.

    While every American deserves a high-quality education, we need to target additional resources on the most talented students to ensure America retains its competitive edge. In particular, we need to provide an incentive to all of America's bright, driven low-income students who want to pursue careers in the sciences. Right now, far too many talented students from poor backgrounds drop out of college or shift away from hard science because of the expense. It's bad for the country.

    One program that the president signed into law earlier this year takes the first major step toward fixing the problem. The SMART Grant program, which I developed, will focus assistance on students in science, math and strategic foreign languages who earn B averages or better during their junior and senior years of college. Next year, the California State University system estimates, more than 3,000 students systemwide -- including many at San Jose State -- will benefit from the program. Many will have their tuition payments eliminated entirely and the numbers will rise in coming years as the program attracts more people into the sciences. Thousands more students in the University of California system will also benefit.

    Of course, tuition subsidies alone can't ensure that we'll have enough talented workers. In the coming months, Congress will consider the president's proposals to improve K-12 math education, increase funding for basic research, support high-risk/high-reward applied science projects, and make the research and development tax credit permanent. Fiscal realities, of course, will play a role in any final decision as Congress examines these proposals.

    Silicon Valley companies already do an excellent job recruiting America's best and brightest. Now the government needs to build on its efforts to increase the ranks of homegrown scientists and engineers.

    I think one very serious point in favor of filing now is if you do not file, and the lawsuit is successful in about a year and a half as they say and your PD hasn't become current by then, it puts everyone who filed in July ahead of you and this might cause the USCIS to retrogress visa numbers to such an extent that it would take ten years for your PD to get current again. Would this be a correct assessment?
