I know some people came here on H1b last year and were able to get EAD. For them it's OK to wait on h1b and keep the EID in safe locker.
But for those who have been here on H1b for long time with many 1 year extensions, it's good idea to use EAD and make as much money you can or at least try to make. If some thing happens to GC application, I don't think we will have enough time and patience to apply once again and wait for the GC.
If you use EAD and make enogh money by the time GC rejected, go back to home country and take early retirement instead of re-appalying for GC and praying the GOD.

@hpandey thanks for standing by me, and more so i will not bow down even if INS were tracking me down , what have i got to lose, its the time for the consultants to lose his business and his money, and i will not stop here as i said , i will make sure google search on him always opens the blacklist page before his company website.
@fide-champ i have tried options that could be open to me till the brink and believe u me if they were there i would be the first to grab it, i have tried attorneys, i have tried references, i have tried many options , given 15 interviews of companies and sat on that interview table from 9 to 5:30 PM , but only after realizing that it wasnt going anywhere and i had blown my dough i realized , its better that i leave.

Ok, clearly you did not read what I wrote or you did not understand it. Here is what I wrote..

Some one left me a red saying "not all consultants from sleazy bodyshopping companies are incapable." I agree and I never said that. If I came across that way then I apologize.

Iam not supporting any malpractises are anything anyways this is not a criminal thing its just immoral ..
Malpractices are criminal (if law is violated) but a corporation cannot be tried criminally because it cannot go to jail.:)

Exactly same thing is going on with me, getting a soft LUD almost every day! (to be precise three times since they received my RFE response). Not sure what's going on?
Ok here is my experience,
had a hard LUD and received RFE for 325A and birth certificates,
Replied to RFE - USCIS received the mail on the 8th, same day in the evening, received a hard LUD saying, RFE response received and is under process.
Till today, I have been seeing soft LUD on our case, I dont know what is going on !!!

I'm talking about the cut-off date in VB. No one can get GC if his/her PD is not prior to the cut-off date. The DOL will determine the cut-off date every month basing on how many 485 applications are submitted for processing in that month. Without substitution, VB might move faster.

Senator Bill Frist introduced the modified senate version of CIR.
That includes "Subtitle B--SKIL Act" SEC 521 to SEC 532
This was done in the senate session before elections:

Is IV interested in doing a Freedom Of Information Act request to USCIS how and when they used up all visa numbers for EB3-India. That might show some information if they cooked the numbers if at all. We might get some more insight which monthly VISA bulletin does NOT give.

I was on F1 (to OPT to H1b) and planning to visit india in January,. I have to go for stamping.

No questions related to job..more about my spouse AOS..officer told me visa is granted and it is almost 1 week and no change in passport status on vfs site. I am bit worried..i will call consulate tonight..

The ideas are good and in the past we have contemplated having a paid member area on IV site too. However the biggest problem we have is - who will manage it?
We all have full time jobs and already have our hands full. Adding anything extra to the current workload will be too much work for us.
Either we hire someone to do it. And to hire we need money. We find it hard to even raise money for Lobbying every other month. There are other important areas like publicity we can look at too if we get more funds. So we cannot hire anyone to manage this.
Now can someone volunteer for it? Yes but how many people come forward with a commitment in a 25k membership? You can see from the thread

Finger Printing: June 2006
It took almost 4 1/2 years to get the labor certification and now its almost 17 months since my I-485 is pending approval. Took the path of writing to the FL, State Senator, Local Congressman and was fortunate to receive their response suggesting that its stuck in the namecheck stage and will have to wait for it to be completed. It has become a nightmare.... The only update in my case used to be whenever I initiate a service request. Now what is that which I can do to come out of this riddle....
Any suggestion in this regard is highly appreciated !!!!
Write to Mr. Bush (no kidding). They will send an inquiry to FBI and you will get something from FBI NNCP (name check division). If that does not help, file a lawsuit against USCIS/FBI. You are right, it is very hard to digest, even for you, who seems to support it. And, if I may add, your example it too "complicated" for me. Try giving easy example for me, I am kind a slow, maybe I should get some "preferential treatment". Yes, that's the word, "preferential".
Country quota is NOT affirmative action, nowhere even close. If you are socio-politically dominated by Indian or Chinese, yes, then it is affirmative action. But if you do not come from a place there Indian and Chinese imperial powers have taken over the country, then how are you socio-politically dominated by Indian or Chinese. And if you are not dominated by Indian or Chinese in the country where you came from, then how could it be "like" affarmative action.
Maybe you yet don't know, but Indian and Chinese EB applications cannot vote and they do not have any representation in the US government. So its not that you are "not properly represented" and Indian and Chinese have all the representation. WE ALL HAVE NO REPRESENTATION. Just so that its clear.
Your next argument is that you are "overwhelmed" by Indian and Chinese so there should be country-limits. Well, I can understand that, we are very overwhelming people. You see 40% of the world population gets 14% green card, we tend to become "overwhelming" for other.

So you should continue to get that PREFERENTIAL TREATMENT. And PREFERENTIAL TREATMENT to you is NOT WRONG AND UNFAIR. Right?

This is really sad that they count all dependents under employement category. USCIS should treat all categories in same way. Can't we raise this issue?
Thats a very good point , If they dont count the dependents in Family based cateogry , why are they counting in Employment Based cateogry . Again may be rules are different but we can defiently raise this question
