You really do not need your labor certificate. You do not need the A# as it is optional. Leave it blank.
You however need to have the 140 petition number. Ask your employer for the number. Tel him you would like to have it for tracking purposes.

Premium processing is not against american values or any other values.
Just because its the government you are dealing with here instead of a private company does not mean there should not be options for faster service for extra fee.
If premium processing is against American values, then in that case, express-mail offered by USPS for extra charge is against American values. Express mail does not slow down first-class 39-cent mail but it provides an ALTERNATIVE to a consumer or citizen to go with better quality service for a fee. For a few dollars, you mail would reach somewhere overnight instead of 3 days.
Also, by that token, first-class travel is against American values? Would you rather that it go away too?

Online information say Indian passport renewal takes around 10 - 15 days but it is usually done much quicker. I received my passport in less than 2 weeks(7 business days if i remember correctly) from Chicago, offcourse i mailed all documents.

Hi,
My employer applied for my H1b Extension and the case was received on Aug 5th by USCIS. The online status still shows the case to be in "Initial Review". Out of curiosity, I called USCIS and they told me that they can only reveal information abuot the case to my employer. So I called my employer and they gave me a shocking news - They had received an RFE about a month ago and they "forgot" to inform me. They are not revealing me the details of the RFE.
We have to respond to the RFE by Nov 3rd, and since I had a change of project(I did provide the previous client letter when we had originally applied for H1b extension) they are asking me to get a client letter and other proofs within a day!!!! My client is taking its on time and I do not think I will get the client letter to send it in time.
1) What are my options here? Not knowing what the RFE is, being told about the RFE with just 2 days remaining, can I threaten to take any legal action against my employer?
2) Is it my right to get a copy of the RFE?
3) How come the case status did not change on USCIS website?
My current visa expires on Nov 20th. Please advice ASAP!

First of all they never did AFAIK. Secondly if they did That would put more than half of the applicants in a situation where they need to find their previous I-94's. If USCIS needs to get all your entry and exit info for the past 10 years and corresponding I-94's I believe they will be talking to Border Security. Even though the airlines take your I-94 away, I believe it will go to a govt agency some how ( I could be wrong).

For F1 students, any off campus employment must be related to their area of study and must be authorized by your school's designated official...

However in this case, I don't even think that selling iPhone apps, constitutes employment. Here is an extreme example : What if I wrote an app and put it on the Apple store and specified that all financial proceeds should go to the OP, without me deriving any kind of labor or tangible benefit from him (a donation of sorts) ? Would that be employment ? If that is considered employment and is illegal then I believe that the OP does not have a case.

You will need to switch to an F1 (Student Visa). You cannot enroll for a full time MBA course on an H1. The college you enroll in will insist on an F1.
As for the GC application, it is for future employment. Meaning that if you company is willing to hire you back once you get your GC and they don't withdraw the I-140, then the application can continue.
However, I think that if and when yr GC gets approved, you will mostly likely have to abandon full time studies and go back to working full time for yr company right away. I only think this and I'm not sure.

I hope they mail it back because that's something I definitely need. I didn't know they will look at my I797. I wish I had known this before my wife went for visa stamping. There's alway a new kink, isn't it :-)
My wife had her visa stamped in Bombay consulate - and during the interview they asked to see the I797 - but i had instructed her to ask for it back and she specifically asked the officer if she could have it back because I needed it - and he promptly gave it.
maybe Delhi Consulate works differently. Hopefully they will mail you back the 797 notice with the passport.

My state in four lines
1) Came to US on F-1 Visa, never completed my masters
2) Shifted to H-1B and i have been with the same client and havent been to India for four years.
3) Now i am doing part time MBA from a top Ivy league school and i have $40,000 in loans from my MBA. i have not finished it as yet.
4) Applied for labor and priority date is Jan 2007 and i wanted to apply for 1-485 and AP and Skip H-1B stamping
But because of the july 2nd i cant do that anymore and i will have to go to H-1B stamping. I wonder what will happen if my stamping gets rejected. If dont attend classes for 4 months. My student loan will start asking for monthly payments. I am in a quagmire.
But still i have decided that i will go to India in any case and if payments become overdue for more months. I dont know what to do.
I had so many hoped on the current numbers . Any idea guys what can i do?

Notify the change of address - If USCIS finds out that you have moved and did not notify with in 10 days of your move then they have the power to revoke and deny your petition.

Updating USCIS using form AR-11 within 11 days is required by law. Can be done online, allows the option to update pending cases with a different mailing address such as PO Box that is different from the home address. AR-11 requires the actual physical home address.
In any event, should call USCIS to confirm change of address on pending applications.

To understand it carefully, as long as the new company can provide me a future job offer, when the PD is current the GC can be approved.
In this case,
1. Should I transfer my H1B with the new company, or it's not required? My job offer will be from the Indian company, and not the US company.
2. In case of business travel, until the PD is current, if I don't have AP renewed which visa should I travel on? As I won't be paid directly from the US counterpart of the company, I am not sure if I can travel using H1 for short time.
Could traveling on B1 visa consider it as abandonment of GC process?

Good point. I am just studying the trade off between "career" and "likability" of job or the job you love. I agree with you about money. I am not just for money or I do not want to be in rat race. (If money is the only goal we all can do real estate bussiness in India) After spending 10 years in engineering, I want to change the field. Even I am ready to go with little less than what I make now. . The main reason is I want to have just relaxing job, not much stress. At the same time it should be a longterm. I thought QA may be one of the field. I do not know yet it is a right thought.
IF you are not in for money there are many stress less jobs than the ones you asked about. You can have stressful job in any field and same is true for the opposite. I know a lot many in engineering that have stress free jobs. Not sure what made you thinking that being SAP consultant is stress free.
If you like teaching and don't have any criminal back ground consider teaching little kids. Most pleasant I can imagine. Work in post office.....VERY QUITE.....

Again, if you apply for extension in April with March paystubs (within 6 months of expiry), then there is a less possibility. But you cant rule that out if they ask for latest stubs in the potential RFE in the future. So its up to you.

My friend (Project Manager) wrote the letter in LetterHead as well as got it notarized/attested. The notarization is only for making sure who ever is the "undersignee" is the actual person. No one else is doing the signature for him.
Better to be safe. My Project Manager friend shouted at me when i asked him to do the notarization on top of the letter head - but i told him "please please....." and he did that :)

I feel stupid replying to this totally irrelevant thread, but I will reply any way. Your bill is for two and a half months duration. That makes it a monthly bill of around $350-360 or so. These are winter months, meaning you must be operating heater full time. If you heater is on a "always on" setting instead of "auto" setting, and you happen to keep any windows in your apartment open all the time,then that alone is sufficient to do you for. Also, if your kitchen burners/oven run on electricity instead of gas, that could also jack up the bill. Taking into account all these factors, it does not sound all that unreasonable, does it? Just check these points before shouting murder.
