Hi, I'm very tensed. I applied for H-1B under master CAP. I have finished all degree requirements including depositing PhD thesis. However, at the time of filing I could not wait for a letter from the registrar (it takes 5 business days).
So, I filed with a letter from my dept. The letter has the letterhead of the university and states that I completed all degree requirements and will graduate May 13th. It is signed by the dept associate dean.
Would that suffice? Could the petition be denied?
I have seen some denials but all for ppl who hasn't actually completed all requirements at the time of filing.
The petition was filed under regular processing, VSC. I got a receipt notice dated April/24. Online status still shows case pending.

Pascal ... I really admire your straight thoughts. I am watching this EB2 Vs Eb3 uproar from last couple of months. Its amazing that we are more focused on this useless conversation rather than taking positive steps and spending our energy to fix the problem. Only if all the affected people start contributing money, start organizing the state chapters, and start participating in the IV activities .. we will see some light at the end of the tunnel. It purplexes me that people use this forum to start war of words, just to keep them busy, but seldom use the forum to unite themselves and fight for the cause.
Please ... I do not want to offend people, just urging everyone to think really hard to solve the problem.

This was well expected. DOS will move the PD's in such a way that 300 applications will be eligible for adjudication when 100 visa numbers were available. At this point in the fiscal year, they don't care about who gets it and all USCIS wants is max utilization.
Don't worry about what IO's said on the phone or at Info pass. No one knows what is happening with 485 adjudications in the last two months.
IMO, DOS should have done a better job with the movement. Jump of Apr 04 to Jun 06 was too much for CIS to handle. Instead of the one month increments in the previous bulletins, DOS should have moved 2 months at a time. Would have made it a little less chaotic. I guess it does not matter.

I can jump around in joy and happiness as my PD is current under Sept. VB. But I am sure it will retrogress next month to pre-2004 ... till than I have 29 days of joy!

Can the owner of this thread please have just the following:
1. A single post containing the basic information about delivery name, address, message, occassion, and delivery date.
2. Just the poll to track the number of people who've sent flowers.
Then we should just start sending emails to friends with the link to that thread.
Please let us make this work. I will try and see if I can alert some media people about this. We need at least 100+ bouquets to make this work. Lets move fast.

I disagree that substituted labors has really impacted immigration..Those labor certifications that were once filed were thought to be used for some one anyway. If the original applicant wasn't laid off or hadn't changed plans, he would still be ahead of the current pending applicants. It's not the biggest of our current problems.
Companies should not have filed GC for all the non-qualified idiots who are currently got ahead of us.

Which center you case went to? Mine went to California service center ( CSC).

This is a good idea. The truth is - to support a bill, you need hundreds of thousands of dollars and few million people supporting it. The agenda IV has, if couple of them get Washington's nod, we will all get GCs. The problem is getting them into congress and eventually getting it passed.
Can we propose a bill which would give us - the honest, sincere, law abiding aliens - a time bound path to Green Card and Citizenship?

what do you mean by supporting IV?
If you are talking about financial donations below model works best for me.
lets say IV core comes up with COST of doing X,Y, Z fixes within XX weeks.
COST is shared among wishing to donate. This becomes like a product purchase.
Current model is not time bound nor result oriented.
Again I am not anti-IV or anything. I am just expressing my idea!
Unfortunately the system does not work that way. Let me ask you this. If you believed in being result oriented and time bound and made an investment to file your green card, when do you think the investment will pay off? Some things money can't buy, it takes tonnes and tonnes of energy to make a change. Believe in this organization and invest your time in helping this organization.
Actively participate in all action items, mobilize your community, your state chapters. Spread awareness and build a sense of cohesiveness. Consider everyone here part of a family and remember everyone who works tirelessly work for all of us, not just them. Find out if there is anyway you can help, there are so many opportunities where IV needs all of us. Stand up, get up and move..

first: my use of an extreme exemple to explain the EB category difference seems to have caused misunderstanding and offence amomg some people. this was not the intention, no slight was intended to anyone. sometimes one uses an extreme situation to make a point (3 yr degree in this case). I was not trying to stereotype and if that is how it came through...here is my humble apology.
i did reply to some of the posters by pm and had some intersting comments/discussion. its one of the nice things about this forum that people bring different insights into a problem...
qvadis, there is fundamental difference between allotting Employment based Gc on the basis of country of birth and based on job classifications/requirements. One happens to pertain to employment, the other is simply a way to mantain ahem "purity".
having said that, i do not favor the removal of country quotas in isolation- the redistribution of dates would make things better for long suffering people but it would not change the overall picture. therefore i support the package in its entirity (as does IV), ie recapture + STEM exemption + removal of country quotas. this would bring in substantially increased numbers and resolve the problem with ROW dates.
now that its established that this thread will not go back to its original intent, do the OPs mind if i close it? may be best to restart the discussion in a new thred?
