same thing happened with my wife's case too, RFE status change on 4/3 and then again a soft lud on 4/6 on my wife and soft lud on mine on 4/7 ... no status change... can you guys let me know once you receive the hard copy... i will update once i receive it...so far havent received and waiting for it...as we have only 30 days to respond...
We received the RFE for the Td vaccine that was missed somehow by Concentra. But since she is nursing now, we were able to get a blanket Waiver for her.

He is not talking about Indians, rather he talks about H1b in general. Since India does not have equivalent social security system, US Govt and Indian Govt did not sign any contracts. Other countries like Canada / UK / AUS have mutual agreement between them and US for transferring the social security paid in US to be transferred to their home country if the alien returns to the home country.
Even Indian Govt (P.Chidambaram) I beleive is working with US Govt to get these SS paid by Indians who have returned back to India. Since the US system and Indian system does not allow with the current rules and regulations to transfer the amount, it is stalled. may be down the line even India would work with US to get these amounts back.
I heard something like this, but not sure: If you decide to move back to India, you can fill out a form and submit to INS/IRS which states that you will never come back to US for any reason. If you do it, they will pay your SS money back. I dont know anymore about this.

I have somewhat uderstood the rulemaking process. What I fail to understand is that since the rule to stop labor substitution is the final rule, does it mean that this rule has been implemented? Or is the next step for OMB to approve the final rule?

We need to do something that catches the attention of the media; just getting more members and more funds may not be enough. We need to write letters to editors of major newspapers like NYTIMES and WASH POST.

I think you missed my point...we need more members because you can't get any one's time if you just want them to do something for you. You have to be prepared to do something for them. For us, when we become citizens, we need to vote. Now do you see why political parties look for numbers?

I sent #7001 form in second week of October , i emailed CIS Ombudsman3-4 days back . I received this email today....

When one switch employers using H1 transfer, the previous employer has to notify USCIS that you are no longer employed with them. The soft LUD's that you are seeing is a result of USCIS going back to the old employers and confirming that you are indeed not working with them...
Its just a procedural thing and nothing to worry about....

I think we should emphasize HR 5882 and write to:
1. The President ASAP
2. Immigration Subcommittee
3. All CHC members
The intention is to bring this bill to the floor this year and make sure it is passed.
I think people with PD 2001, 2002 and 2003 should definitely write as they have a better case than the 2006 or 2007 filers.
This is our last opportunity this year to let go.

My lawyer was not prompt enough to mail the applications by July 2 and after USCIS issue new update, they decided not to file as it will be rejected. In light of the lawsuits, below is the response I got from them?
"In light of the currently pending class action lawsuit against USCIS and numerous requests to file for Adjustment of Status despite the unavailable visa numbers, we have decided to do the following with regards to current filing of adjustments:
If you have an older priority date (EB-2 or EB-3) such as 2004 or earlier, it would most likely be a waste of your time and money to file your adjustment now. It could take over a year and a half (if not longer) for a decision to be reached in the lawsuit, and chances are that your priority date would come current before then, making you eligible to file your adjustment.
If you have an newer priority date (EB-2 or EB-3) such as 2005/6 or later, it may be beneficial to file the adjustment now and become part of the class action lawsuit, but this is just speculation. In any case, the initial filing would be outwardly denied and no immediate benefit would come of it. Even if the lawsuit had a favorable outcome, you will have to refile the adjustment at the time of the court's decision, which would incur more legal fees. Again, it could take over a year and a half (if not longer) for a decision to be reached in the lawsuit, and your priority date could come current before then, making you eligible to file your adjustment and making the lawsuit a big waste of time and money.
Ultimately it is your decision as to what you want to do. We are willing to file your case now if you so wish. Please note that our office will be charging full legal fees for each time the adjustment is filed. The full legal fee will be due upon the initial filing of the case, and again on any subsequent filings of the same case, whenever that may be, as all paperwork will have to be redone.

Keeping our differences on Alexander asides :), thanks for doing the right thing. I greatly appreciate you doing it though you don't live in Michigan.
I totally agree with you on this hypocrite Lou Dobbs and also admire your determination and sticking to your views. I too belive that we can make a change if we are determined. I have written my views to the radio station eventhough I don't listen to that channel as I live somewhere far. I hate to side track the issue but I couldn't control my self to accept that Alexander was great( that apprears in your posts) I stongly belive that he was not great but was a coward (I came to conclusion after reviewing the history)

Agree with vikki76. Infopass and Customer Service numbers are totally useless. Actually, they can do more harm than good as they will open a SR for you, and then when you call back, you are stuck as you have to wait for 30/45/60/90 days.
I think the following will be helpful (I think what worked for me):
1) Try to get a hold of a polite and helpful IO. Keep calling until you get to talk to a nice IO. Reaching an IO does not take more than 30-60 seconds if you call late in the afternoon.
2) Send DHS-7001 form to CIS Ombudsman
3) Letter to Napolitano
I still havent got a response for a letter to the first lady so I am not sure if that works.

I got paranoid because when I contacted USCIS through service request, POJ and ncsc follow up email in September, I came to know that my application is awaiting visa number when clearly dates for my PD were current since Sept 01. Then I tried calling USCIS repeatedly until I got confirmation that both 140 were indeed in place.
After I initiated these requests, my app moved from "awaiting visa number" to " assigned to supervisor" after October 1st. In fact, on Oct 6th,there was LUD on 485 and on Oct 28th, a Hard LUD on my approved 140.
InfoPass won't help much. Usually they just brush people off saying that wait till your PD is current but IO's on phone give more information.

Not true...
In the EB base, only 1 GC is counted for all family members. How can it count more than one if it is a derivative of an employment visa? It might count against the Family base even though primary applicant is EB-based. Not the other way around.

Here's an anecdote -
This was back in the late 80s, when I was growing up - in Bangalore.
India had just lost the Finals of a well fought [field] hockey match to Pakistan. We were all very disappointed by the loss, but it saddened me further to see a victory procession with waving Pakistani flags in the Muslim parts of the City.
Ofcourse, India is a secular country and more so the United States.. and you can cheer whoever you please..
But, If you chose to become a US Citizen, and US were in a battle with your country of Origin (let's narrow it down to Sports, to keep it less complicated), which country would you side? If I chose to side with my country of origin, it would make me a hypocrite, wouldn't it ?

What really baffles me is the attitude of some members in this forum. They contribute $20 a month (some dont even do that) and want to be treated as a Congressman , with updates & news flashes.
Get real people. First of all your contribution of $20 is nothing compared to what we are up against. We want to push for a change in law in a foreign country, which will impact generations of this country with a small contribution of $20.
The point being: If you cant run the show then shut up and watch it. Give your advise when asked for and dont pretend to own it.

So, is it a good idea to wait until next week and then decide the course of action.
Can we send another application just in case? Has anyone talked to their lawyer. As per USCIS, even if they send the application back, it might take 30 days to receive the application. (Understandable, since it is USCIS).

From Greg's yesterday's latest response that there were very few which were returned/rejected on July 2nd itself and this thread proves that we are not alone ...there are so many and status is unknown. Matthew Oh is also suggesting that it will be receipted. I think we are all safe and with time we will get receipt. Nobody...none of the attorney's are suggesting refiling. Now the thought that whether my packet was properly filed or not? I think that will always be there in the back of one's mind but if the attorney has done his/her job correctly I think we should not worry. Its not rocket science and documents required for filing are well known...so I would discount this risk. It appears we are all safe because as we all know that no rejection notices have been generated, packets if returned should have come back by now as per Greg....All in all it all points towards our packets being on hold there at respective centers....but as you rightly pointed out..towards the last week of July keep calling centers to know..but even before that keep eye on check clearing as that by far is the best and earliest clue that all is well with the case.
